An LTD denial is a contractual decision. The complete policy—not only the denial letter or benefits booklet—defines disability, exclusions, offsets, proof obligations and any change from own occupation to another occupational test. The response should be chosen after the contract and limitation issues are reviewed.

Legal framework and scope

An LTD claim is governed first by the policy. The definition of disability, elimination period, offsets, exclusions, proof provisions, treatment obligations, change from own occupation to any occupation, termination age and appeal language must be read together. A denial summary or benefits booklet may omit controlling terms.

The central evidence is functional. Diagnosis explains the medical condition; the policy asks whether its effects satisfy a contractual work-capacity test. The file should connect symptoms and restrictions to the material duties, pace, attendance, reliability, cognitive demands and sustainability of the occupation. A brief ability to perform an activity does not necessarily establish reliable full-time capacity, but exaggerated absolutes can undermine credibility.

Internal appeal and litigation options should be assessed before time passes. Ontario limitation questions can involve discoverability, clear and unequivocal denial, contractual wording and case law. An insurer's appeal process should not be assumed to suspend a legal limitation period. Offsets, rehabilitation, surveillance, independent assessments and return-to-work attempts also require a coordinated record.

Step-by-step process

Step-by-step process: (1) Obtain the complete policy, amendments, certificate and claim file. (2) Identify the operative disability definition for each benefit period. (3) Map material job duties against documented restrictions and limitations. (4) Audit treatment, medication, referrals, barriers and prognosis longitudinally. (5) Analyze the actual denial reasons, surveillance and insurer assessments. (6) Choose appeal, negotiation or litigation while independently protecting time.

Obtain the governing policy

Request the policy, amendments, certificate, booklet, claim forms and correspondence. Identify the elimination period, disability definition, exclusions, recurrent-disability provisions, rehabilitation requirements, offsets and termination terms.

Analyze the stated reason

Separate medical sufficiency, eligibility, functional capacity, treatment, occupation and surveillance issues. The response should answer the reason actually relied on rather than merely provide more of the same records.

Connect function to work

Describe material duties, cognitive and physical demands, pace, attendance, productivity and reliability. Medical evidence should explain restrictions and limitations in relation to those duties, not simply state that the claimant cannot work.

Protect the litigation timetable

Ontario’s Limitations Act contains a general discoverability framework, but policy wording and case law can affect the analysis. Internal appeal correspondence should never be assumed to stop time.

Advanced file analysis

A benefits calculation should run alongside the disability analysis. Identify the gross monthly benefit, pre-disability earnings definition, tax treatment, CPP disability or other offsets, rehabilitation earnings, overpayment allegations and termination provisions. Settlement or litigation advice that considers entitlement but not the economic terms can materially misstate what is at stake.

Medical production should be proportionate and chronological. A large chart is not automatically a persuasive chart. Counsel should isolate records that establish onset, restrictions, treatment response and prognosis, while addressing contrary entries and gaps. Occupational evidence may come from job descriptions, performance records, accommodation documents, supervisors and vocational analysis. The combined question is sustainable function under the contract, not the volume of medical pages.

Evidence and document strategy

Preserve originals, attachments, delivery information, metadata and complete versions. A focused record tied to the applicable legal test is usually more useful than an unstructured volume of documents.

Fictional worked example

Hypothetical: benefits stop at the change from own occupation to any occupation. The insurer points to transferable skills and a sedentary job list. A meaningful response examines whether the proposed occupations are reasonably suitable under the actual policy language and whether the claimant can perform them with sufficient attendance, pace, cognition and reliability—not merely whether the claimant can sit at a desk for short periods.
