What Are Accident Benefits?

The Statutory Accident Benefits Schedule (SABS) is a no-fault insurance scheme built into every Ontario auto insurance policy. It provides immediate financial support for injured persons regardless of who caused the accident. Benefits include income replacement, medical and rehabilitation funding, attendant care, housekeeping, caregiver support, and death/funeral benefits.

Key Benefit Categories

  • Income Replacement: Up to 70% of gross pre-accident income, to a weekly maximum, for those who cannot work
  • Medical & Rehabilitation: Funding for physiotherapy, occupational therapy, psychology, and other treatments
  • Attendant Care: In-home care costs for those with significant physical impairments
  • Housekeeping & Home Maintenance: If your injuries prevent you from performing these tasks
  • Caregiver Benefit: For those who provided care to a dependant before the accident
  • Non-Earner Benefit: For those who were not employed at the time of the accident

Disputes With Your Insurer

Accident benefit disputes are resolved through the Licence Appeal Tribunal (LAT). The LAT process has its own limitation periods, procedural rules, and hearing requirements. We handle LAT proceedings from dispute resolution to arbitration hearings — and judicial review of LAT decisions at the Divisional Court where warranted.
